What is a Patent?

A Patent is an exclusive legal right granted to an inventor for a new, useful, and non-obvious invention — whether it is a product, process, or technology.

Patent Registration Process in India:

Step 1: Patent Search (optional but highly recommended)

Step 2: Draft Provisional or Complete Specification

  • File Provisional if your invention is still being developed

  • File Complete if ready for examination

Step 3: File Patent Application

  • Apply online via the Indian Patent Office portal

  • Published automatically after 18 months

  • Can request early publication (Form-9)

Step 5: Request Examination (Form-18)

  • Must be filed within 48 months of application

  • Examiner checks novelty, inventive step, usefulness

Step 6: Respond to Objections (FER)

  • File reply to First Examination Report (FER)

  • Make technical or legal clarifications

Step 7: Grant of Patent

  • If objections are resolved, the patent is granted and published in the Patent Journal


Patent Validity:

  • Valid for 20 years from date of filing

  • Must be renewed annually from 3rd year onward
